Teacher with HIV sentenced to up to 20 years in prison for having sex with his male students


A homosexual high school teacher who had sex with teenage male students even though he knew he had HIV, apologized to his victims and their families after being sentenced to spend up to 20 years in prison.

Brandon Tomblin, a former Wayne Memorial High School teacher, pleaded guilty to multiple charges including third-degree and fourth-degree criminal sexual conduct, child sexually abusive activity, using a computer to commit a crime and distributing sexually explicit material to children.Wayne County Assistant Prosecutor Brian Surma said the students did not know Tomblin, 27, had HIV.

Though the court heard the teacher did not coerce the three students into the sex, a Michigan law states that teachers cannot have sexual relations with students.
According to the Observer and Eccentric, the former vocal music teacher said he hopes his wrongdoing can serve as an example to students 'what not to do in their adult life'.


To his parents he said: 'I'm so sorry. I love you so much.'
He has agreed to receive counseling and therapy after the incidents.
His attorney Robert Mullen pointed out that Tomblin had been a steadily employed teacher who had no criminal history and who pleaded guilty to spare his victims the emotional ordeal of testifying during a trial.

He said the Sunday school teacher who was 'conflicted by his own sexuality'.
'He didn't stalk or coerce any of the victims. In the words of one of the victims, they wanted something to happen.' The three teens, aged 16, 17 and 18, testified during a preliminary examination in June.

One teen said he had sex with Tomblin in the teacher's office. Another said the sexual acts occurred at his sister's house and in a car parked close to the school.
The third teen said he and Tomblin traded explicit photos on their cell phones, but never had sex. The charges arose after one teen's mother contacted police.
